Hi,
Can someone please advise who is responsible for enforcing the following guidelines which form part of the Contract of Sale for the Wyndham Waters Estate:
1. The commencement of the construction of a residence: our contract of sale states that we had to commence construction of a residense within 1 year of the settlement date. To date there are 2 vacant blocks beside my house that have not started building.
2. Each member must construct a driveway leading from the residence to the road prior to occupation of the residence. There is a property opposite me where the owners have moved in several months ago and have not had there driveway installed as yet.
I contacted the Council today and they advised that they are not responsible for enforcing any of the covenants that were put in place by the developers.
Any help would be appreciated.
